I am divorced can I claim my ex wife's inheritance tax?
Answered by Daniel Barrett
Hi Reginald
Unfortunately not. As a divorcee your estate would be able to claim the £325,000 nil rate band and the £175,000 main residence nil rate band (assuming the total value of your estate is below the £2m threshold at which this begins to get tapered away). The main residence nil rate band only applies where your main residence is passed to a direct descendant such as your children or grandchildren.
Best wishes
Daniel
